Join Kim Whaley, Ian Hull, Bryan Gilmartin, and Suzana Popovic-Montag, for a free webinar this November 6, 2024 at 1pm EST.
In partnership with Canadian Lawyer, Ian, Suzana, Bryan and Kim will be providing attendees with an in-depth analysis of five critical cases from 2024 that are redefining the legal landscape.
The panelists will touch on many interesting topics, including failed fiduciary duties, rectification of wills, and limitation periods.
You can expect to learn about the recent Ontario Court of Appeal decision, Ingram v Kulynych Estate, 2024 ONCA 678 which dealt with whether the ten-year limitation period under section 4 of the Real Property Limitations Act, or the two-year limitation period under s. 38(3) of the Trustee Act applies to equitable claims brought against a deceased individual (where the claim includes claims against real property).
You will also have the opportunity to dive into the panelists’ expert thoughts on Shannon v Hrabovsky, 2024 ONCA 120, where the Court of Appeal provided guidance as to how the discoverability principle in the Limitations Act, 2002, applies to will challenges.
