In Ontario, a recent case involving the death of a dog’s owner has taken the concept of estate disputes to a whole new level. Mr. Carvalho’s girlfriend, Ms. Aliesha Verma, claims Rocco was gifted to her in February 2022 by her late boyfriend. However, the deceased’s family members filed a notice of application, claiming Ms. Verma was never the legal owner of Rocco, and that her possession of the dog remains unlawful. To advance their claim, they rely on a general clause in Mr. Carvalho’s will, which, according to Ms. Verma’s counsel, conspicuously overlooks any mention of Rocco. 

The hearing that determines Rocco’s fate is scheduled for August 3, 2023. The court will face the challenge of determining who will have ownership of the companion animal. This appears to be the first estate litigation matter over a pet before an Ontario Court, placing a spotlight on how Ontario treats pets and objects alike.
